The laws are passed to protect the adults instead of the kids. The bus drivers have a lobby. The superintendents have a lobby. The school boards have a lobby. The teachers have a lobby. It spells out the conditions under which a tenured bus driver may be fired. It makes no difference that LPSS doesn't have a policy. State law provides the proper remedy and procedures. The proper procedure would be to suspend Mr. Mire with pay pending notice and a hearing. The state statute provides that a tenured bus driver may be terminated for "willful neglect of duty, or incompetence, or immorality, or drunkenness while on duty." Certainly a bus driver who blew a .173 at 10:30 at night would still have alcohol in his blood at 6 a.m. when he started his route. Lemoine, Samec and Mire have already agreed to the suspension without pay behind closed doors and called the Board on the phone, otherwise any vote by the Board at the meeting Wednesday would be in violation of state law providing for notice and hearing, prior to suspension. All this may be moot because I believe untimately that Mr. Mire's CDL will be revoked administratively regardless of what the Board or the D.A. does. - yesidoknow Mon, 05 Oct 2009 14:45:49 +0100 http://www.theind.com/home/5028#comment-3452 This guy must have some serious connections. First the procecuting officer does not turn up for the DWI hearing (maybe that officer was well compensated for that absense) then the driver gets arrested for domestic disturbance, then get arrested again for DWI. Does the school board care?
