"Simon’s bill originally designated LaPearlite as the state gemstone, but it’s trademarked and can’t be used."

In other words this is intended to promote the business of a particular jeweler in Mandeville who is polishing oyster shells and owns the trademark. No one else considers "cabochon cut gemstone derived from the Crassostrea virginica mollusk" a gem.

Can you imagine a school teacher trying to explain this chicanery to a child?— "This faux gem commercial product is the state gem because it would have helped the business of some shop in a state rep's district back in 2010.—No, I don't think you can get one, it didn't turn out to be a viable commercial product. Hmmn...maybe that might actually be useful in a social studies class for teaching something about the Louisiana legislature.

There really ought to be a line and this is over it.
