Correction: School Board, ABC clarify Northside track rings

UPDATE: State Rep. Rickey Hardy should have done a little more digging before firing off accusations of misappropriation when it came to a $5,000 donation given to Northside High School by Acadiana Bottling Co.

But the Democratic state lawmaker who seldom holds his tongue wasn't wrong when he said the 2010 boys and girls track teams from Northside High were told they would be receiving championship rings for bringing home two state titles in their respective divisions.

The following is the response from the Lafayette Parish school system to Hardy's accusations of mishandling donations, which were highlighted in the original blog post at the bottom of this page:

The company and Northside signed a contract in June 2006 that included annual support to the school, to be spent at the principal’s discretion. Also included in the contract was $5,000 to pay for championship rings for that year’s basketball team, as well as $2,500 to pay for a sign for the gym commemorating that year’s basketball championship.

That donation for championship rings was only for the first year of the contract, which again was signed in June 2006.

It currently is 2011, which is year five of the contract in question. During year five, the contract states, the school will receive annual funding to be spent at the discretion of the principal “to benefit Northside High.”

Acadiana Bottling has been a longtime supporter of LPSS and the school system is grateful for their continued support.

Minutes after The Ind received the school system's response, we also received the following press release from Acadiana Bottling General Manager Marcel Bulliard. The release affirms the statement from LPSS, but the company goes further in explaining how the request for the annual donation was made and what the money was initially intended to fund:

Acadiana Bottling has enjoyed a long standing contractual agreement with Northside High School as well as other Lafayette Parish Public Schools.  Our contract provides the schools, including Northside High School, with an annual cash payment to be used by the school at the discretion of the principal for the benefit of the school.

Payments under the contract were made to Northside High School at the direction of the principal.  In 2010, Acadiana Bottling received a request from Northside principal, Mr. Handy, for a $5,000.00 payment under the contract which Mr. Handy expressed he intended to use for the purchase of championship rings for the track team.  Acadiana Bottling made the $5,000.00 contractual payment after Mr. Handy was no longer the principal at Northside and the payment was received by the school’s then acting principal.

In responding to Mr. Handy’s request it was not the intention of Acadiana Bottling to do anything other than make a payment pursuant to the contract following the principal’s request.  No special earmarks were attached to these funds.  The payments were made subject to the provisions of the contract and to be utilized at the discretion of the principal.

Original Story: When Northside High School’s boys and girls outdoor track teams both brought home state championship titles in 2010, Acadiana Bottling Co. offered a big congratulations in the way of a $5,000 donation to the school for each track team member to receive a commemorative championship ring.

It’s been six months since Acadiana Bottling cut the check, according to state Rep. Rickey Hardy, and Northside’s championship runners have yet to receive those rings despite the money being deposited into Northside’s account.

Hardy says a Northside school administrator told parents that the check was not given specifically for rings. But after reviewing a copy of the check, Hardy says misappropriation is one word to describe Northside’s actions thus far in not delivering to the student athletes.

“Someone is stealing from these students,” Hardy says. “It’s the grinch who stole their championship rings.”

The Democratic state rep. sent a letter Thursday to Superintendent of Schools Burnell Lemoine asking for answers. He also sent copies of the letter to each School Board member and the acting principal of Northside.

Hardy learned of the donation scandal in March, he says, but waited almost six months before inquiring about the check to see if the rings would surface. He has yet to receive any response from central office, he says.

LPSB marketing director Angie Simoneaux says the school system will release a response to Hardy’s letter Monday afternoon.

This situation should be rectified immediately. Hopefully, we will hear the rings had been ordered and are just late in arriving. DONORS BEWARE! There may be some stumbling blocks along the way, so donors should maybe check to ensure the money is used as they intended.

Now, what does the school board need a "marketing" director for? It makes me feel as if Laf Parish School system needs to use "marketing" tricks, campaign ads, to convince the public to support it. It just sounds sneaky.

I sure hope Mr. Hardy continues to keep everyone on their toes!

Evidently, Acadiana Bottling must have written on the check "For Championship Rings", or something to that effect, or else Rep. Hardy wouldn't be on this like an IRS agent. I pity the administrator if he or she lied about the check. LPSS will have to do something, or they will have no credibility at all.

And TAXPAYERS BEWARE!! You are going to be forced to "donate" more of your tax dollars to hire consultants upon consultants --- note the $17+ million consultant contract awarded by the school board -- BEFORE you have had a chance to vote on the outrageous $561 million dollar construction project in October. This is a 75 per cent increase in your property taxes - from 33 mills to 58 mills. The way this contract was awarded is proof that this school board cannot be trusted with your money. VOTE NO IN OCTOBER.

A lot of the larger high school clubs and sports (usually the booster club) have their own checking accounts and would've been better recipients for that money.

How about doing away with all athlectic programs at any under performing schools.Take the athlectic budgets and direct them back to the class room.By the way this should of been brought to the board first theres a chain and protocal needs to be followed first.Dont agree with the board on alot of issues but they were blindsided here.Is it possible the donor didnt make there wishes clear.Lets hope this isnt more Hardy grandstanding.When will the Headlines read hardy helps bring jobs and respectability to his district.Wake up people we need coperation and coalition builiding.Enough of the bitterness,and hate.

politicians can't do that. if you want jobs and respectability in an area and you look to politicians to bring it, then your mind is stifled and your initiative lacking.

jobs and respectability are a product of the individuals living in an area, and the companies doing business in an area. the most government can do is stay out of the way.

If Hardy is not a conduit for the advancement he is a deterrant.So what exactly was he elected to do.Ragin my mind and eyes are wide open.Hardy is full of gas. So you contacted the board why is this a press release.Fame hogs and dividers make the best and worst politicans.He thinks if his name is constantly mentioned we will think he is doing a service to the district.

Besides what politician on the state level does not look for ways to help his district prosper economicaly.The man does nothing no mentoring for the youth.No jobs, set up a academic program to insure that 2.0 you fought for.Which i agree they should have however i doubt if he maintained one himself.

Hardy should be made to apologize.These were strong alleagtions.He revels in controversy ,Ricky youll look back on your legacy one day and it want be pretty.Why are you so bitter.If you search for good youll find it.Just like if you look for bad youll find it.In the future how forth comming will this donor or any for that matter be in supporting the schools.Nobody likes there business attach to controversy.

Beware!'. Your vote for the school tax will only get you 1. A new Lafayette HS & Northside HS 2. A new auditorium at Comeaux! That's it, Nothing more, $561 Million Dollars to demolish two schools and build two new schools. Yet, there's 36% literacy in some schools AND NP Moss was shut down for poor performance. And now they ask you to give them $561 million WITHOUT, WITHOUT, WITHOUT a superintendent in place. Vote NO for the school tax until these 9 elected board members cam produce a superintendent who can be hired and produce a plan to increase literacy, graduation rates, and develop a repair/rebuild plan for our schools.

I WILL VOTE NO ON MORE PROPERTY TAXES FOR THE SCHOOL BOARD OR ANY OTHER AGENCY !!! Everyone should vote no. I cannot afford another $400 a yr, esp for an agency that has proven it has no will to even pretend it will be fiscally conservative with that money. Open up those closed schools that were not performing. Close down those specialty schools. Students can attend "trade" schools or universities. The need for more money is a LIE perpetuated by the school board and those businesses who will get contracts from LPSB.

And if you rent, you will pay those taxes.

It seems that Mr. Hardy will create DRAMA from nothing. Why did he not speak to the principal, perhaps she had a very good reason for what she did. Mr. Hardy should really consider a career change such as a reality show where drama sells, I would suggest Basketball Wives.

I think the kids should get their rings & if this money was not earmarked, it still could be used for it. I'm glad Mr. Hardy is on top of the ring situation but maybe he was a little strong on the accusations... Maybe he knows something I don't. If he's wrong, I think he's a big enuf man to say "Hey I got carried away in my enthusiasm for the kids." & "I'm sorry." But if those kids get their rings, I'm still glad he was on top of it. Its not hard to worry kids from that school will be overlooked, even if its unintentional. I love track. I love the fact its a sport that kids can do for themselves if they want to. I sure would like to know those kids are encouraged and recognized for their accomplishments.

Beware the dark pit of the LPSS "general fund!" Some years ago, a well-constituted and motivated group of parents formed an organization to attempt to build a new band facility for Lafayette High utilizing private donations. After initial success, including large monetary commitments, the effort faltered because LPSS would not allow money to be escrowed by the organiztion. Requiring that any funds raised be turned over to LPSS to be held in the, you guessed it, "general fund!" This intransigence was a deal-breaker for the folks who were ponying up large donations and the effort collapsed.

The "general fund" is a very scary account with too many "hands in the pot" and no real accounting. Funds are deposited and then cease to exist. There are many sub accounts and no dual control. Ask to see the books sometime. It is an interesting "rabbit chase".

With the manner in which donated money sticks to LPSB and LPS's I would say businesses would certainly do best with their money in awarding a scholarship to deserving students, everyone knows that every facade of government is a deep bottomless pit of greedy thiefs and leading the pack of thiefs is the LPSB !Acadiana Bottling, should demand their money be returned through the courts.

There are professionals that can prescribe medication for Rep. Hardy, please will someone step up to the plate and get this man help. I'm sure state legislators have great medical insurance, if not let's raise some funds. This man has officially lost it!!!!!
